Misdemeanor larceny under North Carolina General Statute 14-72(a) occurs when a person (1) takes (2) personal property (3) in the possession of another and (4) carries it away (5) without the consent of the possessor and (6) with the intent to deprive the possessor of its use permanently (7) knowing that he or she was not entitled to it.

Misdemeanor larceny is a class 1 misdemeanor with a maximum punishment under the law of 120 days incarceration and a discretionary fine not limited by the statute.
